Description
The civil secretary, a personal appointee of the Lieutenant Governor, conducted the whole internal management of the province, initiating or handling all public business and dealing with petitions for favours and appeals from decisions made by subordinate authorities. For much of the period from the establishment of civil government in 1764 to the union in 1841, the offices of Civil Secretary to the Governor and Clerk to the Executive Council were held in plurality by one man. The offices of Civil and of Provincial Secretary were briefly held in plurality by John Ready from 1820 to 1822.
This collection of records relating to the Rebellions of 1837-1838, consists of minutes of proceedings for the trials conducted by the magistrates, 1837-1838, and the proceedings of the militia courts martial, 1838-1839, for the London District; contemporary copies of the 1839 proceedings in the Court of Queen's Bench in England resulting in the release of ten out of twenty three men from the Niagara District intended for transportation to Australia; records of the inquiry into the conduct of Colonel John Prince at the Battle of Windsor, 1839; proceedings of the courts martial at Fort Henry, Kingston, 1838-1839; and documents relating to the prosecution of Alexander McLeod for the destruction of the CAROLINE, 1841.
Le secrétaire civil, dont la nomination relevait du lieutenant-gouverneur, contrôlait l’ensemble de l’administration interne de la province. Il s’occupait de toutes les affaires d’ordre public, des demandes de faveurs et des contestations soulevées par les décisions prises par des autorités subalternes. Pendant la majeure partie de la période allant de l’établissement du gouvernement civil en 1764 jusqu’à l’Union de 1841, les fonctions de secrétaire civil du gouverneur et de greffier du Conseil exécutif étaient cumulées par une seule et même personne. Entre 1820 et 1822, John Ready a brièvement cumulé les postes de secrétaire civil et de secrétaire de la province.
Cette collection est constituée de documents portant sur les Rébellions de 1837-1838 comportant les procès-verbaux des délibérations tenues lors des procès de la magistrature en 1837-1838, et les procédures des cours martiales de la Milice pour le district de London en 1838-1839, ainsi que des copies contemporaines des procédures de la Cour du banc de la reine en Angleterre en 1839, menant à la libération de dix des vingt-trois hommes du district de Niagara condamnés à la déportation en Australie. On y trouve aussi des documents de l’enquête sur la conduite du colonel John Prince lors de la bataille de Windsor en 1838, des procédures des cours martiales tenues à Fort Henry, Kingston, 1838-1839, et des documents relatifs à la poursuite judiciaire contre Alexander McLeod pour la destruction de la CAROLINE en 1841.
